TERMS OF SERVICE

DISCLAIMER• By purchasing my services (art), you automatically agree to the following conditions as well as my rules which are public and will be reminded as necessary.
• Please read this entirely and carefully. I will refuse your commission if you do not agree to these terms.
• If you are not comfortable with my Terms Of Service and/or are not willing to agree to the conditions, you may not request a commission.
• Clients are NOT permitted under any circumstances to use any part of commissioned work from @Frouponic such as images, goods, and copies of goods in any block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space. Using any commissioned work is also strictly prohibited from use in any advertising or profits associated with block-chain related technology including non fungible tokens (NFT), cryptocurrency, or future inventions in the space.• Any aspect of work by @Frouponic may not be used to train, validate, or test any neural network or artificial intelligence. Doing so is in violation of terms against alteration and external non private use of assets created for patrons.USER AGREEMENTBy commissioning me, you agree that you have read and accepted all the terms described herein.You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.Violators will be added to a blacklist indefinitely and without warning with any additional appropriate actions taken.

General

All prices listed are in USD.


Client- Commissions are for Personal Use only unless commercial rights are purchased.
- My artwork may be used for personal display such as profile pictures, banners, posting on socials with credit to @Frouponic, or printing for yourself, but may not be used for profit without prior agreement.
- You may display my work on external sites as long as it is visibly credited and linked back to me. Please only upload the smaller, watermarked file publicly unless otherwise discussed.
- You may not upload or host my work in any gallery intended to display your own work only.
- You may not claim my work as your own, remove signatures/watermarks, or fail to credit me.
- You may not trace over my artwork in any way, including using it as a "base."
- In the case of an adoptable, you retain the rights to the character design (not the illustration itself — see Copyright).
- AI/NFT use is strictly prohibited. My work may not be used in AI datasets, AI engines, or minted as NFTs.
- I only accept commissions from clients 18 years of age or older. If you are a minor, a parent or guardian must handle the commission and payment on your behalf.
- Any personal information you share with me (contact details, payment info, reference images, shipping address for physical items) will be kept private and used only to complete your commission.
- Any harassment in an attempt to bargain for a slot is not tolerated, including inappropriately worded comments on my socials or in private messages. This will result in blacklisting.
- Clients who commissioned or received work before this TOS took effect are still bound by its contents.
- By placing an order, you agree to these terms and conditions.


Artist- By commissioning me, you are purchasing my service as an artist only — you are not purchasing ownership of the artwork itself (see Copyright).
- I reserve the right to decline any project or client for any reason, including subjects outside my abilities or subjects I will not draw.
- I reserve the right to refund you in full if I no longer wish to continue your project, for any reason.
- I reserve the right to post finished work in my gallery/portfolio unless an NDA has been agreed upon beforehand.


I will not draw:- Religious art, mecha, political content
- Anything offensive or bigoted (racism, homophobia, transphobia, incest, pedophilia, etc.)
- Certain fandoms (disclosed on request)

Commercial Usage Agreement

If you wish to order a commission for commercial use, total price (and any royalties, if applicable) will be agreed upon upfront.Commercial use includes: reproducing or selling the artwork, publicly or privately, or profiting from a platform where the artwork is posted (e.g. Patreon, YouTube, Twitch, a personal/business site, business cards).Pricing tiers (added to base price):

I reserve the right to charge more if I deem it necessary for a specific project.

NDA / Privacy Request

Privacy requests must be stated during the ordering process, before payment.
- The NDA fee is $100 (flat).
- This means I will not share WIPs publicly, post the finished piece, or stream any part of the process.
- In turn, you agree not to share WIPs or spoiler details yourself until agreed otherwise.
- This is especially relevant for VTuber debuts or other reveal-sensitive projects — let me know upfront if that's the context.

Payments & Fees

- Payments are made through the agreed platform (PayPal, USD only). You are responsible for any currency conversion on your end.
- For commissions under $100, full payment is due upfront before work begins.
- For commissions $100 and over, payment is split in half: the first 50% is due upfront before I begin, and the remaining 50% is due once the sketch is approved, before I move to final rendering.
- For larger projects, extended payment plans may be available — please reach out to discuss before ordering.
- PayPal invoice fees are the client's responsibility and are not included in the listed price.
- Full payment (including tax) is due within 1 week of the proposal/invoice being sent, unless otherwise discussed for larger orders.
- I will initiate the invoice — please do not send payment before I've confirmed I can accept your commission and requested payment.
- If payment isn't made within 48 hours of the invoice (unless otherwise discussed), the commission will be cancelled. Repeated failure to pay after committing to a slot will result in blacklisting.
- I do not accept payment from shared PayPal accounts, unless you are a minor using a parent/guardian's account.
- A Non-Disclosure Agreement (NDA) fee of $100 applies if you request that I not post your commission publicly or use it in my portfolio. See NDA section below for what this covers.

Ordering Process

- Please read this TOS and my commission price list before reaching out.
- Your slot is only confirmed once I reply confirming the details.
- Requests should be worded concisely with minimal abbreviations, in English, so nothing gets lost in translation. Miscommunication due to language barriers is the client's responsibility.
- I reserve the right to make small adjustments to your request for artistic/style reasons unless otherwise discussed.
- If your request is unusually detailed, I may charge an additional fee — this will be disclosed before the transaction, and you may adjust your request to avoid it if you prefer.
- Once everything is confirmed, I will send an invoice. Please wait for the invoice before sending any payment.

Revisions & Work-in-Progress

- You will receive a sketch WIP once your initial payment is received (full amount for orders under $100, or the first 50% for orders $100 and over) — this is where your revisions apply. For split-payment orders, the remaining 50% is due once the sketch is approved, before I move to final rendering.
- You're welcome to request additional WIPs beyond the sketch stage, spaced at least 3 days apart, to avoid interrupting workflow.
- 2 free revisions are included at the sketch stage. Additional revisions at this stage are $15 each, paid before I continue.
- Once the sketch is approved and I move to final rendering, only minor adjustments are possible — color corrections are free, but major changes (pose, character swaps, etc.) require a fee based on the scope of the change.
- Once the final piece is approved, no further changes will be made, unless due to an error on my part — my mistakes are always corrected free of charge.
- If no feedback is given on a WIP, you're responsible for any dissatisfaction with details that weren't flagged at the time.
- I will not redraw a completed commission without payment for a new order.

Deadlines, Queue & Delivery

- I typically take up to 3 weeks to begin work on a commission, with an additional 4–8 weeks to complete it depending on complexity, queue, and my health/personal matters. I'll keep you updated if delays occur.
- I typically respond to initial inquiries within 3–5 business days.
- Commissions are worked on based on complexity and scheduling, not strictly in the order received.
- If you have a hard deadline, let me know before payment — I reserve the right to decline a project if the timeframe isn't feasible.
- Please don't send progress reminders during the standard queue window — I'll notify you proactively if anything changes.Rush Fee- A rush fee of +25% of the commission price applies if you need your piece prioritized ahead of the standard queue.
- Rush fees may vary depending on the project and requested timeframe.
- Estimated start dates can be given on request but aren't guaranteed.

Copyright & Intellectual Property

- I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.
- I may use the artwork to promote myself and my services, and post it on social media/portfolio — unless an NDA was purchased, in which case it will not be posted or used promotionally.
- I will send a full-resolution file (email or Google Drive); my signature/watermark remains on both full-res and smaller versions.
- You're responsible for protecting your own claim to a custom character design (e.g. watermarking your own uploads with your name) when posting externally.
- In the case of an adoptable, once ownership transfers to you, I will not reuse or resell the design.
- For standard commissions, I will not reuse/resell the artwork for other personal or commercial projects unless agreed upon.

Final Product & Files

- I reserve the right to decline critiques relating to artistic skill or stylization.
- You are responsible for saving your files once delivered. I aim to retain files for up to 3 months, but cannot guarantee against loss from computer failure or accidental deletion.
- I'm not obligated to keep a posted piece public indefinitely, even if it was a paid commission — please keep your own copy.
- Feedback on the final piece is welcome via private message. Rude, inappropriate, or inflammatory comments may result in blacklisting.


Refunds- Refunds are not available once work has started, unless I am unable to complete the commission — in that case you'll be refunded in full.
- You may cancel before payment is made, at no cost.
- If I choose to cancel a project on my end, you'll be refunded in full.
Chargebacks- Chargebacks are strictly prohibited.
- If your PayPal account malfunctions or issues a refund without your knowledge, contact me immediately so we can resolve it directly.
- If you need to cancel, please contact me directly rather than disputing the payment.Filing a chargeback will:- Forfeit your rights to use the artwork
- Place you on a public blacklist (with evidence)
- Allow me to resell or reuse the artwork as I see fit
- Result in a formal complaint against you
- Apply to any associated email, PayPal account, or side accounts used

Commissioner Rights — Quick Reference

You may:- Use the artwork for personal purposes only (unless commercial rights purchased).
- Print the art for yourself.
- Post it on social media with credit to @Frouponic.You may NOT:- Use the artwork commercially without permission.
- Claim the artwork as your own or fail to credit me.
- Remove signatures/watermarks.
- Resell or redistribute the artwork.
- Modify the artwork without my consent.
- Use personal-use artwork in merch, streaming, or commercial projects.

Blacklist Policy

- Breaking these terms may result in a permanent, public blacklist (with evidence).
- The blacklist may be shared with other artists.

Final Agreement

By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
